Thank you for using Handyman.dealplex.

For your information: Handyman.dealplex Private Limited is a company incorporated under the Companies Act, 2013, with its registered office at Office no.528B, Gera Imperium Rise, Wipro Circle, Hinjawadi Phase II, pahse 2, Hinjawadi, Pune, Pimpri-Chinchwad, Maharashtra 411047 (hereinafter referred to as “We” / “Handyman.dealplex” / “Us” / “Our”).

For abundant clarity, Handyman.dealplex and/or the trademark "Handyman.dealplex" are neither related, linked, nor interconnected in any manner or nature to any other entity or business with a similar or confusingly similar name.

These terms and conditions (“Terms”) govern your access to and use of the Handyman.dealplex platform and the six services offered through it (collectively, the “Services”).

 

*Acceptance of Terms

These Terms are intended to make you aware of your legal rights and responsibilities with respect to your access to and use of Handyman.dealplex’s website https://shopHandyman.dealplex.in/ ("Site") and/or any related mobile or software applications (collectively referred to as the “Handyman.dealplex Platform”), including but not limited to the six services offered by Handyman.dealplex via the Handyman.dealplex Platform or otherwise ("Services").

Your use and access of the Handyman.dealplex Platform shall be governed by these Terms and the Privacy Policy of Handyman.dealplex as available at https://Handyman.dealplex.in/privacy (“Privacy Policy”). By accessing the Handyman.dealplex Platform and/or undertaking any transaction or use of Services, you agree to be bound by these Terms, including any additional terms and conditions and policies referenced herein or available by hyperlink on the Handyman.dealplex Platform, and acknowledge that this constitutes a legally binding agreement between you and Handyman.dealplex. You may not access or use the Handyman.dealplex Platform or Services if you do not accept these Terms or are otherwise unable to be bound by them and the Privacy Policy.

These Terms may be updated from time to time by Handyman.dealplex without prior notice. It is therefore strongly recommended that you review these Terms as posted on the Handyman.dealplex Platform each time you access or use the Handyman.dealplex Platform. In the event of any conflict or inconsistency between these Terms and any other terms of use that appear on the Handyman.dealplex Platform, these Terms shall prevail.

The terms ‘visitor(s)’, ‘user(s)’, ‘you’, ‘your’, and ‘customer(s)’ hereunder refer to the person visiting, accessing, viewing, browsing through, and/or using the Handyman.dealplex Platform at any time.

Services Overview

The Handyman.dealplex Platform is a platform for consumers to transact with third-party sellers who offer products and services for sale through the Handyman.dealplex Platform. For abundant clarity, Handyman.dealplex does not provide any services directly to users other than offering the Handyman.dealplex Platform as a medium to facilitate transactions at your own cost and risk, and any other services as may be specifically notified to you in writing.

The services on the Handyman.dealplex Platform are available only in select geographies within India.

Handyman.dealplex is not and cannot be a party to any transaction between you and third-party sellers, nor does it have any control, involvement, or influence over the products purchased or services availed by you from such third-party sellers (including the prices charged by such sellers). Consequently, Handyman.dealplex disclaims all warranties and liabilities related to any products or services offered on the Handyman.dealplex Platform.

 

Eligibility

Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872, including minors, undischarged insolvents, etc., are not eligible to use or access the Handyman.dealplex Platform. However, if you are a minor (under the age of 18 years), you may use or access the Handyman.dealplex Platform only under the supervision of an adult parent or legal guardian who is “competent to contract” and agrees to be bound by these Terms.

You are prohibited, even under supervision, from purchasing any product(s) intended for adult consumption or whose sale to minors is prohibited, including tobacco products.

The Handyman.dealplex Platform is intended for end-consumers who wish to purchase products or avail of services for domestic or personal use. Retailers, institutions, wholesalers, or any other business-to-business users are not eligible to use the Handyman.dealplex Platform.

To ensure compliance with eligibility criteria, Handyman.dealplex may use algorithms or pre-determined criteria-based technology, which may result in restrictions or blocks on your usage if overlap with such criteria is detected. If you believe you are a genuine user and face such restrictions, please contact us for assistance.

If you use the Handyman.dealplex Platform on behalf of any person or entity, you represent and warrant that you are authorized to accept these Terms on their behalf. You and such person or entity shall be jointly and severally liable and indemnify Handyman.dealplex for any violations of these Terms.

 

Account & Registration Obligations

All users must register and log in to place orders or use services on the Handyman.dealplex Platform. You must keep your account and registration details current and accurate to ensure effective communication regarding your purchases and interactions on the Handyman.dealplex Platform.

By agreeing to these Terms, you consent to receive promotional, transactional, or other communications and newsletters from Handyman.dealplex and its group companies/affiliates. You can opt out of such communications and newsletters using the opt-out options provided within those messages. Additionally, you may update your notification preferences in the profile section of the Handyman.dealplex Platform.

When you access and use the Handyman.dealplex Platform, we may collect personally identifiable information including, but not limited to, your name, email address, age, address, mobile phone number, and other contact details; demographic profile information such as age, gender, occupation, education, and address; preferences and information about your interactions on the Handyman.dealplex Platform, such as pages visited, links clicked, and frequency of visits to specific pages or features. We may also collect transaction-related information, including financial details and any other information necessary to provide you with our services and manage the Handyman.dealplex Platform. All personal and identifiable information collected is subject to Handyman.dealplex’s Privacy Policy.

By registering your mobile number with Handyman.dealplex, you provide consent to be contacted by us or through third-party service providers via phone calls, SMS notifications, mobile applications, or other electronic modes of communication for order updates, shipment and delivery notifications, customer support, and any other correspondence necessary for the provision of our services.

 

Limited License & Access

Subject to the provisions set out in these Terms, Handyman.dealplex grants you a personal, limited, non-exclusive, non-transferable, and revocable license to access (for personal use only) the Handyman.dealplex Platform and avail the services offered, only as expressly permitted in these Terms. You shall not download (other than page caching) or modify any portion thereof, except with the express prior written consent of Handyman.dealplex.

This limited license does not include or permit any resale or commercial use of the Handyman.dealplex Platform or its contents; any collection, use, or derivative use of the Handyman.dealplex Platform, its contents, product listings, descriptions, or prices; any downloading or copying of information for the benefit of any third party; or the use of data mining, robots, or similar data gathering and extraction tools.

You agree and undertake not to use, host, display, upload, modify, publish, transmit, update, or share any information, content, message, language, or document (including pursuant to gifting services, printing services, or orders to be delivered to third-party recipients, or messages delivered along with orders) — whether written or otherwise — in connection with the Handyman.dealplex Platform, including communications with support agents or delivery partners, that:

•    Belongs to another person and to which you do not have rights;

•    Is harmful, threatening, abusive, indecent, discriminatory, tortious, vulgar, profane, harassing, blasphemous, defamatory, obscene, pornographic, pedophilic, libellous, invasive of privacy, hateful, racially or ethnically objectionable, disparaging, encouraging money laundering or gambling, or otherwise offensive, inappropriate, or unlawful;

•    Violates the standards of the services;

•    Accuses others of illegal activity or describes physical confrontations;

•    Attempts to impersonate another person or entity;

•    Disguises or attempts to disguise the origin of your content or messages, including false names or IP address masking;

•    Harms minors in any way;

•    Infringes any intellectual property rights;

•    Violates applicable laws or may result in civil or criminal liability;

•    Contains software viruses or any code that disrupts functionality;

•    Threatens the unity, integrity, defense, security, or sovereignty of India, friendly relations with foreign states, or public order;

•    Is misleading or false;

•    Attempts any of the above.

Handyman.dealplex has no obligation to monitor your or others’ use of the platform for violations but reserves the right to do so to operate and improve the services, ensure compliance with Terms, and comply with legal requirements.

Any liability arising from violations of these Terms is your sole responsibility, not that of Handyman.dealplex.

No portion of the Handyman.dealplex Platform may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for commercial purposes without prior written consent from Handyman.dealplex.

You may not use framing techniques to enclose any trademark, logo, or proprietary information of Handyman.dealplex or its affiliates without prior written consent.

You may not use meta tags or hidden text using Handyman.dealplex’s name or trademarks without prior written consent.

You shall not attempt unauthorized access to any portion of the Handyman.dealplex Platform or connected systems through hacking, password mining, or other illegitimate means.

Any unauthorized use will automatically terminate the license granted, at Handyman.dealplex’s sole discretion.

 

Advertising

Parts of the Handyman.dealplex website may contain advertising information, promotional material, or other content submitted by third parties, brands, or customers. The responsibility for ensuring that any material submitted for inclusion on the Handyman.dealplex Platform complies with all applicable international and national laws lies solely with the party providing such material.

Your correspondence, business dealings, or participation in promotions with advertisers (other than Handyman.dealplex) found on or through the Handyman.dealplex Platform—including payment and delivery of related goods or services, and any other terms, conditions, warranties, or representations associated with such dealings—shall be solely between you and the advertiser. Handyman.dealplex will not be responsible or liable for any errors, omissions, inaccuracies in advertising materials, or any loss or damage incurred as a result of such dealings or the presence of advertisers on the Handyman.dealplex Platform.

For any information related to charitable campaigns ("Charitable Campaigns") sent to customers or displayed on the Handyman.dealplex Platform, where customers may donate money through (a) payments on third-party websites, or (b) deposits to third-party bank accounts, Handyman.dealplex is not involved in the collection, management, or utilization of such funds. Handyman.dealplex does not accept responsibility or liability for the accuracy, completeness, legality, or reliability of any information related to Charitable Campaigns. Such information is displayed for informational purposes only, and customers are advised to independently verify the details before taking any action.

As part of advertising, marketing, or visibility campaigns, brands, advertisers, or sponsors may run banner content, sampling schemes, contests, flyer distributions, or other promotional campaigns on or via the Handyman.dealplex Platform. Notwithstanding anything to the contrary, you agree that to the fullest extent permitted by law, Handyman.dealplex shall have no liability in connection with such campaigns (including contests or contest rewards), which are solely arrangements between you and the respective brands, advertisers, or sponsors, including fulfillment of any obligations.

Participation in such campaigns, accessing embedded third-party links, scanning codes, or availing of services pursuant to these campaigns shall be at your own risk and will be governed by the terms and conditions of the campaigns and the relevant brands, advertisers, or sponsors. Handyman.dealplex makes no representation or warranty of any kind, express or implied, regarding such campaigns. The brands, advertisers, or sponsors shall be solely responsible for their fulfillment.

 

 

Disclaimers

You acknowledge and agree that the Handyman.dealplex Platform and the Services are provided on an “as is” and “as available” basis, and that your use of the Handyman.dealplex Platform and Services shall be at your sole risk. To the fullest extent permitted by applicable law, Handyman.dealplex, its group companies, affiliates, and their respective directors, employees, officers, agents, and representatives (“Handyman.dealplex Parties”) disclaim all warranties, express or implied, in connection with the Handyman.dealplex Platform, the Services, and your use thereof.

To the fullest extent permitted by applicable law, Handyman.dealplex makes no warranties or representations that the Handyman.dealplex Platform and Services will be provided with complete accuracy or completeness of content, and assumes no responsibility for any:

1.    Errors, mistakes, or inaccuracies in the content on the Handyman.dealplex Platform or the Services;

2.    Personal injury or property damage of any nature resulting from your access to or use of the Handyman.dealplex Platform and Services;

3.    Unauthorized access to or use of Handyman.dealplex servers and/or any personal information stored therein;

4.    Interruption or cessation of transmission to or from the Handyman.dealplex Platform;

5.    Bugs, viruses, trojan horses, or other malicious code transmitted to or through the Handyman.dealplex Platform or by any third party;

6.    Loss of your data or content from the Handyman.dealplex Platform; or

7.    Errors or omissions in any content or any loss or damage incurred as a result of using any content posted, emailed, transmitted, or otherwise made available via the Handyman.dealplex Platform.

Any material downloaded or obtained through the use of the Handyman.dealplex Platform is done at your own discretion and risk, and you are solely responsible for any damage to your computer system or loss of data resulting from such downloads.

The Handyman.dealplex Parties are not responsible for monitoring any transaction between you and third-party providers of products or services. You are solely responsible for all communications and interactions with other users of the Handyman.dealplex Platform and Services.

No advice or information, whether oral or written, obtained from Handyman.dealplex or through the Services shall create any warranty unless expressly stated in these Terms.

Unless expressly authorized in writing by Handyman.dealplex, you agree not to use any trademark, service mark, trade name, or logo of any company or organization in a manner likely or intended to cause confusion regarding ownership or authorized use.

You acknowledge that you are exercising your best and prudent judgment before entering into any transactions. Handyman.dealplex makes its best efforts to display available products, including their color, size, shape, and appearance, as accurately as possible. However, actual products may vary in color, size, shape, or appearance from what is displayed on your screen.

Handyman.dealplex does not make any representations or warranties regarding the products or services (including digital goods) available on the Handyman.dealplex Platform, nor does Handyman.dealplex implicitly or explicitly endorse or support the sale or purchase of such products or services. Handyman.dealplex accepts no liability for errors, inaccuracies, or omissions from third parties or for information received from third parties and provided through the Handyman.dealplex Platform.

The terms and conditions of the third-party seller, issuer, or brand of products (including digital goods such as software, gift cards, or vouchers) apply in addition to these Terms. You acknowledge and agree that Handyman.dealplex does not have ownership, control, or title over any products subject to sale and purchase agreements between you and the relevant third party seller.

Handyman.dealplex has no control over the quality, merchantability, fitness for purpose, or availability of products and is not responsible for damages, delays, or out-of-stock situations related to such products.

 

 

Delivery Partners

We facilitate the delivery of orders placed on the Handyman.dealplex Platform through independent contractors, i.e., delivery partners, on a principal-to-principal basis. For clarity, these delivery partners are neither employees nor agents of Handyman.dealplex. They are purely associated with Handyman.dealplex as independent service providers and are not exclusively bound to provide delivery services at any given time.

There is no principal-agent relationship between Handyman.dealplex and the delivery partners, and therefore, Handyman.dealplex cannot be held liable for any acts or omissions of the delivery partners under any circumstances.

You are expected to respect the dignity and diversity of the delivery partners and to support a secure and harassment-free gig work environment. This includes the prevention and deterrence of any form of harassment, including sexual harassment, toward delivery partners.

Handyman.dealplex reserves the right to withhold or limit your access to the Handyman.dealplex Platform at our sole discretion if you behave toward any delivery partner in a discourteous, disrespectful, abusive, inappropriate, or unlawful manner.

You are expected to treat all delivery partners with courtesy and respect. Any claims or compensation demands arising from your inappropriate actions toward delivery partners shall be your sole responsibility.

 

Customer Comments, Reviews, and Ratings

“Comments” include, but are not limited to, reviews, feedback, images, photos, audio, video, location data, nearby places, likes, ratings, messages, chat communications, profile information, and any other material shared, uploaded, or transmitted in connection with the services provided on the Handyman.dealplex Platform. All Comments submitted, shared, or published on or in connection with the use of Handyman.dealplex’s platform/services shall be and remain the property of Handyman.dealplex.

By submitting your Comments, you irrevocably grant Handyman.dealplex a perpetual, worldwide, non-exclusive, royalty-free, fully paid, transferable, sub-licensable license to use, publish, display, distribute, translate, reformat, create derivative works, analyze, promote, commercialize, or incorporate into advertisements or other content across any medium. This includes the right to use your name or username in connection with such Comments.

If you upload photos or images as part of your Comments, you confirm that they are relevant to the product/service being reviewed, clear and directly taken by you, and do not include promotional material or content violating these terms.

Handyman.dealplex is under no obligation to:

•    Maintain any Comments in confidence,

•    Pay compensation for any Comments,

•    Respond to any Comments.

By submitting Comments, you confirm that:

•    You are the sole author or have necessary permissions to post the Comments.

•    The Comments do not infringe any intellectual property, privacy, or other rights of any third party.

•    Your Comments are truthful, accurate, and reflect a genuine experience.

•    Your Comments are not influenced by any payment or incentive.

You agree not to upload or submit Comments that:

•    Are unlawful, abusive, defamatory, or obscene,

•    Contain viruses or harmful code,

•    Are political, promotional, or spam in nature,

•    Involve impersonation or misrepresentation.

You agree to indemnify Handyman.dealplex against all liabilities arising from any Comments you submit. You shall be solely responsible for your Comments and any consequences resulting from sharing them.

Handyman.dealplex reserves the right to monitor, moderate, publish, remove, or disable access to any Comments for any reason, without prior notice. We are not obligated to return any Comments under any circumstances. We do not guarantee the accuracy, integrity, or quality of any Comments, and all liability lies with the Customer who posts them.

Third-party content and Customer Comments do not reflect the opinions of Handyman.dealplex. Handyman.dealplex is a neutral platform and does not arbitrate disputes. If any review is found to violate our policies, the concerned party may report it by contacting sales@Handyman.dealplex.in. We may, at our sole discretion, remove such content if deemed to violate our terms or harm our services.

 

 

Customer Feedback

If you share or send any ideas, suggestions, changes, or documents regarding Handyman.dealplex’s existing services (“Feedback”), you agree that:

1.    Your Feedback does not contain confidential, proprietary, or secret information of any third party.

2.    Handyman.dealplex is under no obligation of confidentiality with respect to such Feedback and may use it freely and without restriction.

3.    Handyman.dealplex may have already received similar Feedback from other users or it may already be under internal development or consideration.

4.    By providing the Feedback, you grant Handyman.dealplex a non-exclusive, royalty-free, perpetual, worldwide license to use, develop, publish, distribute, and sublicense such Feedback. You also irrevocably waive any claims against Handyman.dealplex or its users related to such Feedback.

Please provide only specific Feedback related to Handyman.dealplex’s existing services. Do not include ideas or concepts that Handyman.dealplex does not permit itself to review or consider under its policy.

Despite this request, if you still submit unsolicited ideas—including but not limited to new advertising campaigns, product or service enhancements, technologies, processes, materials, or brand names (“Submissions”)—the following terms shall apply:

1.    Your Submissions and all their content will automatically become the property of Handyman.dealplex, without any compensation to you.

2.    Handyman.dealplex may use or redistribute such Submissions and their contents for any purpose and in any manner.

3.    Handyman.dealplex is under no obligation to review any Submissions.

4.    Handyman.dealplex is under no obligation to maintain the confidentiality of any Submissions.

This policy is designed to avoid potential misunderstandings when Handyman.dealplex’s services or marketing strategies may appear similar to unsolicited ideas submitted by users.

 

Intellectual Property

Handyman.dealplex and/or its brand or seller partners (as applicable) expressly reserve all intellectual property rights in all text, programs, products, processes, technologies, images, content, and other materials appearing on the Handyman.dealplex platform (“Intellectual Property”). Access to or use of the Handyman.dealplex platform does not grant or imply any license or sub-license to any Intellectual Property. All rights, including copyright, in and to the Handyman.dealplex platform are owned by or licensed to Handyman.dealplex. Any use of the Handyman.dealplex platform or its Intellectual Property, including copying or storing any part of it, is strictly prohibited without prior written consent from Handyman.dealplex.

You may not modify, distribute, or re-post any material from the Handyman.dealplex platform for any purpose. The names, logos, service marks, trademarks, slogans, and related product or service identifiers are owned by Handyman.dealplex, its affiliates, partners, suppliers, or service providers. Any other trademarks appearing on the platform are the property of their respective owners. No rights, title, or interest in any such marks are granted through access to or use of the Handyman.dealplex platform. References to third-party names, products, or services—if included—are for user convenience only and do not imply endorsement, sponsorship, or recommendation by Handyman.dealplex.

Handyman.dealplex may feature third-party content or link to third-party websites, content, products, applications, or services (collectively, “Third-Party Content”) as a service to users interested in such information. Handyman.dealplex does not control, endorse, screen, or guarantee any Third-Party Content. The presence of any such content or link does not constitute endorsement or affiliation. Handyman.dealplex assumes no responsibility for any Third-Party Content, its accuracy, reliability, or legality. Your decision to access third-party websites or use third-party services linked through Handyman.dealplex is entirely at your own risk and discretion.

Handyman.dealplex respects the intellectual property rights of others. If you believe your intellectual property rights have been infringed or misused on the Handyman.dealplex platform, you may report it by contacting: (sales@Handyman.dealplex.in). We will review your claim in accordance with applicable laws and internal policies and may request additional details to assess the claim. Please note that submitting false, misleading, or inaccurate claims may lead to legal consequences, including civil or criminal liability.

Information Disclosure

To protect against loss, misuse, and unauthorized alteration of the information under its control, Handyman.dealplex has implemented appropriate physical, electronic, and managerial safeguards. While we strive to maintain the confidentiality and security of your personally identifiable information, please understand that transmissions over the internet cannot be guaranteed to be completely secure. By using the Handyman.dealplex platform, you acknowledge and agree that Handyman.dealplex shall not be liable for any disclosure of your information caused by transmission errors or unauthorized actions by third parties.

 

 

Call Recording: All calls between you and Handyman.dealplex (including calls involving our service partners or third parties engaged by us) may be recorded for internal training, quality assurance, and service improvement purposes. By using our services, you explicitly consent to Handyman.dealplex and its authorized third parties recording these calls and sharing such recordings with authorized personnel, service partners, and relevant third parties as necessary.

You also expressly consent to Handyman.dealplex sharing any data, including call recordings, related to you with our group companies, affiliates, and/or governmental or regulatory authorities if required by applicable law.

 

 

Misrepresentation

Handyman.dealplex assumes no responsibility for any communication not authorized by Handyman.dealplex regarding offers, promotions, sales, or any other activities. This includes, but is not limited to, any fraud or misrepresentation caused by third-party administrators resulting in loss or injury to users. Users are cautioned that Handyman.dealplex does not operate any call centers and does not provide any landline/mobile numbers, email IDs, social media channels, or other electronic communication methods for user contact, except those specifically mentioned in these Terms.

You are advised to be vigilant against unauthorized persons, fraudsters, or imposters claiming to represent Handyman.dealplex. If you wish to communicate with Handyman.dealplex, please use the following email addresses or the faster in-app chat option:

Please note: Handyman.dealplex will never solicit confidential information such as OTP, CVV, PIN numbers, or card details via call, email, or any other channel. Do not share such sensitive information if requested by email, phone, or any other means. Avoid divulging these details to anyone claiming to represent Handyman.dealplex.

 

You Understand, Agree & Confirm

• That you shall be solely responsible for providing accurate delivery details including recipient name, address, and contact information. You are also responsible for all payments made through your Handyman.dealplex account, whether for your own use or on behalf of someone else. Handyman.dealplex shall not be liable for any refund or order cancellation due to incorrect or incomplete details provided by you.

•That if any product/service delivery is delayed, returned, or fails due to incorrect details, recipient unavailability, or refusal to accept the order, Handyman.dealplex bears no responsibility for redelivery. Any costs incurred in such cases shall be borne by you.

• That Handyman.dealplex makes every effort to ensure delivery of products/services within the estimated time displayed during order placement, but does not guarantee delivery times. Delays may occur due to factors such as availability of delivery partners, weather, traffic, high demand, force majeure events, or other unforeseen challenges beyond Handyman.dealplex's control.

• That delivery will typically occur when a person is available at the provided address. If you instruct the delivery partner to leave the package unattended or with a third party, you accept full responsibility for any loss, theft, tampering, or damage and waive the right to claim refunds or compensation from Handyman.dealplex.

• That for cash on delivery orders, it is solely your responsibility to ensure the correct cash amount is paid to the delivery partner. Handyman.dealplex is not liable for any overpayment, underpayment, or disputes arising therefrom.

• That you agree to use the services of Handyman.dealplex only for lawful purposes, and will comply with all applicable laws and regulations while accessing or transacting on the Handyman.dealplex platform.

• That all information provided by you is true and accurate, and Handyman.dealplex reserves the right to verify any information at any time. If any part of the information is found to be false, Handyman.dealplex may reject your registration, cancel your orders, and ban your access to its services without any liability or prior notice.

• That all transactions made through the Handyman.dealplex platform are done at your own risk and discretion. You are advised to exercise judgment and prudence before entering into any transaction.

• That orders may include additional charges such as delivery fees, convenience fees, high demand surcharges, packaging charges, gift fees, or any other service-related charges. These will be clearly disclosed at checkout. By placing an order, you agree to pay these Service Charges, which may vary depending on various factors such as time of day, cart value, traffic, weather, or order location.

•That you have reviewed the product/service description carefully before placing the order, and agree to abide by the terms of sale as outlined therein.

• That while using the Handyman.dealplex platform, you may encounter content that some may find offensive, indecent, or objectionable. You agree to access such content at your own risk, and Handyman.dealplex will not be liable for any discomfort or damage resulting therefrom.

• That Handyman.dealplex reserves the right to modify, suspend, or discontinue any service or product offering at any time without notice. Changes to features, content, or availability may occur as part of our platform evolution.

• That the Handyman.dealplex app and services may require automatic updates or upgrades. You agree to allow such updates to be pushed to your device unless otherwise restricted by your device settings. Updates are essential for improved service, bug fixes, and feature enhancements.

• That Handyman.dealplex may, from time to time, conduct experiments or tests on certain app features, interface designs, or promotional campaigns. As a result, some users may experience features differently. This is aimed at improving user experience, safety, innovation, and service quality.

 

Taxes on Your Order

In respect of the order placed by you, Handyman.dealplex shall issue documents such as order summaries, tax invoices, and other applicable documentation as per prevailing laws and standard business practices. Your order may include the following components and corresponding documents, depending on the nature of services availed:

•    Supply of Goods by Third-Party Sellers Listed on the Handyman.dealplex Platform

o    A Tax Invoice cum Bill of Supply shall be issued on behalf of the respective third-party seller.

o    A Tax Invoice shall be issued by Handyman.dealplex or the applicable third-party service provider.

All relevant documents will be accessible on the Order Summary page once the order has been successfully delivered.

You acknowledge and agree that any entitlement to GST benefits on goods or services purchased via the Handyman.dealplex Platform is subject to:

•    The applicable GST laws and conditions.

•    Submission of a valid GST number at the time of order placement, as prompted on the Handyman.dealplex Platform.

These GST-related terms are deemed to be part of the overall Terms of Use by reference and may be updated or amended by Handyman.dealplex without prior notice.

Order Cancellation-

You acknowledge that:

•    (a) Your cancellation, or any attempted or purported cancellation of an order, or

•    (b) Cancellations due to reasons not attributable to Handyman.dealplex

shall be considered a breach of these Terms. Any such cancellation request will only be permitted at the sole discretion of Handyman.dealplex. For permitted cancellations, Handyman.dealplex may initiate a refund, which could be issued in the form of promotional codes, coupons, or credit, usable for future transactions on the Handyman.dealplex Platform, subject to applicable terms such as validity duration.

Order Cancellation by Handyman.dealplex

Orders may be cancelled by Handyman.dealplex under the following circumstances:

•    (a) Suspected fraudulent or suspicious transactions

•    (b) Non-compliance with or violations of these Terms

•    (c) Unavailability of product(s) or services

•    (d) Technical errors or unforeseen logistical/delivery issues beyond our control

In such cases, refunds (if applicable) will be initiated within approximately 72 hours of order cancellation.

Handyman.dealplex takes all reasonable efforts to ensure the accuracy of product/service specifications, pricing, and availability. However, in the event of an error (due to system or third-party issues), Handyman.dealplex reserves the right to cancel the order and issue a refund or promotional credit accordingly.

We also reserve the right to restrict access to users found to be non-compliant or engaging in fraudulent activity, and may cancel future orders placed by such users.

 

Returns & Refunds

At Handyman.dealplex, customer satisfaction is our priority. However, once a product or service is delivered, it is considered non-returnable, non-replaceable, and non-exchangeable—except in the following circumstances: (a) if the product is found to be damaged, defective, expired at the time of delivery, or incorrectly delivered; and (b) if the specific return, replacement, or exchange policy associated with that product or service expressly permits such action. In such cases, the request for return, exchange, or replacement will be processed according to the terms, conditions, and timelines mentioned in the respective policy. We urge customers to carefully review the return and exchange policy provided on each product or service page on the Handyman.dealplex platform before placing an order or requesting a return or refund. Valid proof of the issue (such as clear images or videos) must be submitted for any resolution to be initiated.

For digital goods—including but not limited to gift cards, vouchers, online subscriptions, and other intangible services—no return or refund shall be applicable. In case of any issue related to usage, validity, or redemption, customers are advised to directly contact the respective issuer or seller. The issuer's terms and conditions will apply in addition to the general Handyman.dealplex terms.

All refunds for eligible returns or cancellations will be processed within 7 working days from the date of return or cancellation approval, subject to verification and approval. For transactions made via electronic payment methods (such as debit card, credit card, net banking, UPI, etc.), refunds will be issued through the original payment method or, in some cases, via Handyman.dealplex credits, cashback, promotional codes, or coupons—depending on the nature of the transaction and applicable terms. These credits can be used for future purchases on the Handyman.dealplex platform and will be subject to any validity period mentioned. Refunds processed as credits will reflect in your account as per your bank's timeline.

For orders placed via Cash on Delivery (COD), refunds will only be processed through promotional codes, which are valid for 30 days from the date of issuance. Users may also choose to receive promotional code refunds even for online payments. Once issued, such codes or credits cannot be transferred to any other payment method. All other promotional codes issued by Handyman.dealplex for any purpose will remain valid for 7 days unless specified otherwise.

All refunds shall be made in Indian Rupees (INR) only and are non-transferable. This policy applies across all six services offered on the Handyman.dealplex platform. We recommend customers familiarize themselves with the specific policies associated with each service type before placing an order or requesting a refund.

 

Handyman.dealplex Cashback Policy

The following terms are in addition to, and not a replacement for, any other terms governing the use or access of the Handyman.dealplex platform.

"Cashback" refers to the credit granted to a user’s Handyman.dealplex account, representing the eligible cashback amount. This credit will be reflected in the user’s account but shall not, under any circumstances, be transferred to a bank account, card account, or refunded in cash. Cashback offered by Handyman.dealplex may either be transactional (linked to specific purchases) or promotional (issued as part of a marketing campaign), and users will be entitled to receive cashback only when explicitly specified by Handyman.dealplex.

Cashback is not applicable on cancelled orders, and any cashback shown or granted in relation to such orders may be revoked by Handyman.dealplex without prior notice. Additionally, if a refund is requested—either partially or fully—for an order that had cashback applied, the cashback amount will be adjusted accordingly and may be deducted based on the portion of the order that is refunded. This rule applies even if cashback is displayed at the item level.

Handyman.dealplex reserves the right, at its sole discretion and without prior notice, to withdraw, suspend, modify, or cancel any cashback offers and their associated terms at any time, without any liability. Cashback—whether transactional or promotional—will typically be reflected in the user’s Handyman.dealplex account within 24 to 48 hours from the transaction, but in some cases (especially promotional campaigns or coupon-based offers), it may take up to 7 working days from the date of successful delivery for the cashback to appear.

Unless otherwise stated, transactional cashback will remain valid for 90 days, and promotional cashback for 60 days from the date of credit. Handyman.dealplex may alter these validity periods at its discretion, which will be communicated through the platform when applicable.

It is important to note that Handyman.dealplex does not promote or endorse any specific product or transaction solely on the basis of cashback availability. Cashback and discount codes may not be valid on certain services or products offered through the Handyman.dealplex platform, as may be determined and updated by Handyman.dealplex from time to time.

This cashback policy applies across all six services offered on Handyman.dealplex. We recommend that users carefully read the specific cashback terms listed with each service or promotional campaign before proceeding with any transaction.

 

Printing Services Policy

The following terms apply specifically to the use of printing services offered on the Handyman.dealplex platform and are in addition to all other general terms and conditions governing access to and use of the Handyman.dealplex website and services.

To avail Handyman.dealplex's printing services, customers must upload a soft copy of the desired document, file, image, text, or data in a supported printable format (collectively referred to as “Document(s)”) through the Handyman.dealplex platform. If the document is already listed or available for printing on the platform, the user can simply trigger a print request. Once the request is received, the documents will be printed and delivered to the customer.

Customers are strictly advised not to upload any content that falls under Prohibited Conduct, as outlined in Handyman.dealplex's usage terms. While Handyman.dealplex strives to maintain the confidentiality of all uploaded documents, customers must understand that uploading any sensitive or confidential documents is done at their own risk. Handyman.dealplex does not permanently store any documents; they are retained only temporarily for the purpose of fulfilling the printing request.

Charges for printing services will be clearly displayed before an order is placed, and users are required to make payment—possibly in advance—to complete the order. Handyman.dealplex reserves the right to revise printing fees or related charges at any time without prior notice. Additionally, in order to process and deliver your print orders, Handyman.dealplex may share uploaded documents with its affiliated or franchisee stores.

If the customer receives defective or incorrect printouts, they must report the issue within 24 hours of delivery by sharing photos of the defective items along with the order number with Handyman.dealplex’s customer support. Complaints received after the 24-hour window may not be entertained, although Handyman.dealplex will make reasonable efforts to assist wherever possible.

By using Handyman.dealplex’s printing services, the customer agrees to use the services only for lawful purposes and in compliance with all applicable laws and regulations. Uploading documents on Handyman.dealplex implies the customer’s consent to the collection, temporary storage, and use of the information solely for fulfilling the printing request, in accordance with Handyman.dealplex’s Terms of Use and Privacy Policy.

The customer acknowledges that printing services are availed at their own discretion and risk, and they are expected to exercise sound judgment before initiating any transaction on the Handyman.dealplex platform. This printing service policy applies across all six services offered by Handyman.dealplex.

Handyman.dealplex Gifting Services

The following terms apply specifically to the gifting services offered on Handyman.dealplex and are in addition to, and not a replacement for, the general terms and conditions governing the use of the Handyman.dealplex platform and its six integrated services.

Handyman.dealplex allows you to place orders for eligible products to be delivered as gifts to recipients of your choice. Gifting services are available only for certain products explicitly marked as eligible (“Eligible Products”) on the Handyman.dealplex platform. You agree to use this service responsibly and only to send gifts to individuals who are known to you, ensuring that your use of the service does not cause discomfort, inconvenience, or embarrassment to the recipient.

To place a gift order, you must provide accurate and complete contact information for the recipient, including their name, address, phone number, and any other details necessary to complete the delivery. By using this service, you confirm that you have obtained the recipient’s consent to share their personal information with Handyman.dealplex for the sole purpose of order fulfillment.

You agree to indemnify and hold Handyman.dealplex and its partners harmless from any disputes, legal claims, or issues raised by the recipient regarding the use of their contact information. Under no circumstances should the gifting service be used to harass, intimidate, or cause harm to the recipient in any way. You also accept full responsibility if the recipient refuses the gift or expresses dissatisfaction, and acknowledge that Handyman.dealplex bears no liability in such situations. If the recipient is unreachable, Handyman.dealplex or the delivery partner may attempt to contact you for guidance or resolution.

Gifting-related fees or service charges may apply, and these will be clearly displayed before you confirm your order. In many cases, payment must be made in advance and Cash on Delivery (COD) may not be available for gift orders. By placing a gift order, you agree to pay the applicable charges in full as displayed at checkout.

Handyman.dealplex may also allow you to include a custom message along with your gift. While we will do our best to ensure the message is delivered as part of the gift package, this may not always be possible due to logistical or technical constraints. All such messages must comply with Handyman.dealplex’s terms on Prohibited Conduct and must not include offensive, inappropriate, or illegal content.

This gifting service policy applies across all six services offered by Handyman.dealplex, and users are encouraged to use the feature responsibly to ensure a smooth and positive experience for both the sender and the recipient.

 

Handyman.dealplex Third-Party Services

The following terms apply to third-party services available on the Handyman.dealplex platform and are in addition to, and not in substitution of, the general terms and conditions governing the use of Handyman.dealplex and its six services.

From time to time, Handyman.dealplex may collaborate with external third-party providers to enhance your overall experience on the platform. These services may either be part of a bundled offering with products or be made available for optional selection at the time of checkout. Examples include—but are not limited to—installation services for specific products, demo sessions, consultation, or any other support service facilitated through marketing campaigns or product offerings.

By opting in for such third-party services or by placing an order that includes services from a third-party provider, you acknowledge and agree to the following:

•    These services are independently provided by third parties and are governed exclusively by their respective terms and conditions. Handyman.dealplex has no control over or involvement in the actual execution of such services, including aspects like scheduling, delivery, quality, order tracking, customer service, or grievance redressal.

•    You explicitly consent to the sharing of your personal information and order details with the third-party service provider as necessary for fulfillment. Once shared, your data will also be subject to the third party’s privacy policy in addition to Handyman.dealplex's.

•    Handyman.dealplex makes no representations or warranties, whether express or implied, regarding the quality, accuracy, timeliness, reliability, or suitability of the third-party services. All such services are provided on an “as is” basis by the respective service providers.

•    You understand and agree that any engagement with a third-party service provider is at your sole risk. Handyman.dealplex and its affiliated entities shall not be liable for any claims, damages, or losses (including theft, service failure, or dissatisfaction) arising out of or in connection with the third-party services.

•    By using or availing any such third-party service through Handyman.dealplex, you agree that Handyman.dealplex will not mediate or involve itself in any disputes or issues that may arise between you and the third-party provider.

These provisions apply across all six services on the Handyman.dealplex platform. We encourage users to review the third-party service providers' terms before opting in and to exercise due diligence when availing any such services.

 

Terms and Conditions for EMI on Credit and Debit Cards

The following terms and conditions (“EMI Terms”) shall apply to all transactions made using the Equated Monthly Installments (“EMI”) facility on the Handyman.dealplex website and mobile application (“Platform”) and are in addition to, and not in substitution of or derogation to, the terms and conditions governing the use/access of the Platform. By opting for the EMI facility, you (“Customer” or “You”) agree to be bound by these EMI Terms.

1.    EMI Facility Availability

You may opt for the EMI payment method on purchases of values acceptable to the issuing bank made on the Handyman.dealplex Platform, subject to the availability of the EMI facility from your issuing bank.

2.    Exclusions

The EMI facility is not available on purchases made using UPI, net banking, prepaid payment instruments, Buy Now Pay Later options, or Cash on Delivery methods

3.    Combining Products

You may combine multiple products from various third-party sellers or brands on the Handyman.dealplex Platform into a single purchase and convert such purchase into an EMI.

4.    Issuing Bank’s Role

The EMI facility is offered solely by the respective issuing banks. Handyman.dealplex does not play any role in the approval, extension, pricing (including applicable taxes), modification, pre-closure, closure, repayment, or any other matter related to the EMI facility, which is at the sole discretion of the issuing bank.

5.    Bank Terms and Disputes

You agree to be governed by the respective terms and conditions of the issuing bank offering the EMI facility. For any complaints, disputes, or inquiries regarding the EMI facility or EMI transactions, you must contact the issuing bank directly.

6.    Information Accuracy

Handyman.dealplex displays EMI-related information based on details provided by the issuing banks on an “as is” basis. The issuing banks are the authoritative source of such information. Handyman.dealplex shall not be held liable for any disputes arising from the EMI facility or any inaccuracies in the information displayed.

7.    Order Cancellation and Refunds

If you cancel an order before the issuing bank converts the purchase into an EMI, you will be entitled to a full refund. However, if the EMI has already been processed by the issuing bank before cancellation, applicable fees charged by the bank and relevant taxes will not be refunded.

8.    Payment and EMI Conversion

You agree to pay the total order value at the time of payment as per the debit or credit card terms. The amount will be converted to EMI by your issuing bank according to their policies.

9.    No Processing Fees by Handyman.dealplex

Handyman.dealplex does not charge any processing or convenience fees for facilitating the EMI facility.

10.    Right to Amend or Withdraw EMI Facility

Handyman.dealplex reserves the right to suspend or stop offering the EMI facility on the Platform, or to amend these EMI Terms at any time without prior notice.

11.    Communication of Bank Terms

Any additional terms specific to the issuing bank will be communicated to you at the time of availing the EMI facility via push notification, hyperlink, SMS, email, or other written formats, either by Handyman.dealplex or the issuing bank.

12.    Limitation of Handyman.dealplex Liability

Handyman.dealplex solely facilitates the EMI options offered by banks and is not responsible for any aspects of the EMI, including but not limited to restructuring, refunds, returns, foreclosure, or disputes.

 

Handyman.dealplex Terms and Conditions for No Cost EMI on Credit Cards (“Offer”)

 

•  Offer Description

By availing this Offer, you understand that you will receive an upfront discount equal to the EMI interest cost charged by the respective issuing bank, effectively making the EMI interest cost zero.

•  Taxes and Charges

You agree and acknowledge that all applicable taxes on interest and any other charges related to this Offer will be levied by the respective issuing bank.

•  Eligibility of Offer

The discount under this Offer applies only when you opt for the ‘No Cost EMI on Credit Card’ payment option on the Handyman.dealplex Platform.

•  No Waiver of EMI Interest

You acknowledge that this Offer does not amount to a waiver of EMI interest by the issuing bank.

•  Product Availability

You agree and understand that this Offer may not be available on all products listed on the Handyman.dealplex Platform.

•  Bank Discretion

The applicability of the Offer is subject to the discretion and directions of the issuing bank.

•  Handyman.dealplex’s Liability

Handyman.dealplex shall have no liability or obligation in case the issuing bank refuses or fails to process this Offer for any reason.

•  Timely Payments

You understand and acknowledge that failure to make timely EMI payments to the issuing bank may result in additional interest or penalties charged by the bank, which may exceed the discount provided under this Offer. Handyman.dealplex shall not be responsible or liable for any delayed or non-payment of EMI.

•  Returns and Refunds

In case of any returns or refunds made on EMI purchases, the interest already billed on the transaction will not be refunded under any circumstances.

•  Processing and Cancellation Charges

The issuing bank may levy processing or cancellation charges as per their policies. You agree to bear and pay all such charges.

•  Right to Modify or Cancel Offer

Handyman.dealplex reserves the right to modify or cancel this Offer at any time without prior notice, including due to changes or modifications made by third-party sellers or brands offering this Offer.

Handyman.dealplex - Specific Additional Terms for Purchase of Cigarettes, Tobacco Products, Hookah, Rolling Papers, and Nicotine Products

By using the Handyman.dealplex Platform to purchase cigarettes, tobacco products, hookah, rolling papers, or nicotine products (“Restricted Products”), you agree and undertake the following:

1.    Minimum Age Requirement

You confirm that you are at least eighteen (18) years of age or older.

2.    Distance from Educational Institutions

You confirm that you reside outside a radius of one hundred (100) yards from any educational institution.

3.    Compliance with Law

You will not use the Handyman.dealplex Platform to purchase Restricted Products if you are below 18 years of age and/or live within one hundred (100) yards of an educational institution. Similarly, you shall not place an order for any person below 18 years of age or living within 100 yards of an educational institution.

4.    False Declaration and Consequences

If you make any false declaration or misrepresent your age or location to become eligible for purchasing Restricted Products, Handyman.dealplex reserves the right to take appropriate actions, which may include cancellation of orders, suspension of your account, or legal action as permitted by applicable laws.

 

Handyman.dealplex - Promotional Terms

 

These additional terms apply to promotional campaigns (“Offer”) live on the Handyman.dealplex Platform from time to time. Users who place orders on Handyman.dealplex and satisfy the eligibility criteria set forth by Handyman.dealplex or its collaboration partners for the specific promotional campaign shall be termed as “Eligible Customer(s).”

1.    Offer Duration and Cancellation

Offers shall run for the duration decided by Handyman.dealplex, at its sole discretion, and may be revoked prematurely without prior notice.

2.    Order Returns and Refunds

If the Offer is based on a minimum order value or specific product category, the Offer will stand cancelled if the products are returned by the Eligible Customer or refunded by Handyman.dealplex, or if the order for such products is cancelled by the Eligible Customer. Once the benefit/prize of the Offer is availed/redeemed, the Eligible Customer agrees that the corresponding order cannot be returned or refunded.

3.    Third-Party Services Disclaimer

Handyman.dealplex and its affiliates shall not be liable for any services provided by third parties in connection with the Offer, including vouchers, prizes, or benefits.

4.    Consent to Share Information

Eligible Customers provide explicit consent to Handyman.dealplex to share their contact details (“Information”) with authorized third parties for Offer fulfillment. Such Information will be governed by the third parties’ privacy policies, and Eligible Customers are encouraged to review those policies before participating.

5.    Geographic Restrictions

Offers are only available to Eligible Customers whose account settings on Handyman.dealplex are set to India and whose billing address is in India.

6.    Modification Rights

Handyman.dealplex reserves the right to modify or alter any of these terms at any time without prior notice.

7.    Non-transferability

Offers cannot be sold, transferred, encashed, exchanged, or combined with any other Offer.

8.    No Liability for Third-Party Errors

Handyman.dealplex accepts no liability for any errors or omissions by any third party relating to the Offer.

9.    Communication of Benefits

Details of vouchers/prizes/benefits will be sent to Eligible Customers via email, SMS, WhatsApp, or in-app notifications.

10.    Right to Exclude

Handyman.dealplex reserves the right to exclude any Eligible Customer from the Offer or cancel the Offer wholly or partially without liability if it believes the Eligible Customer has:

•    Breached these terms or any other applicable terms and policies.

•    Acted dishonestly, fraudulently, or in bad faith.

•    Tampered with the Offer process.

11.    Limitation of Liability and Dispute Resolution

•    Handyman.dealplex will not mediate disputes between Eligible Customers and third parties related to the Offer.

 

Payment Facility and Related Information

1.    Payment Currenc

All payments towards orders and/or services on Handyman.dealplex shall be made exclusively in Indian Rupees (INR).

2.    Accepted Payment Methods

At the time of payment, Handyman.dealplex will display the accepted payment methods which may include, but are not limited to: credit cards, debit cards, net banking, UPI, cash on delivery, or any other payment modes approved by the Reserve Bank of India (RBI). Please note that cash on delivery may not be available for certain orders.

3.    Third-Party Payment Processors

To facilitate payments, Handyman.dealplex may use third-party vendors and service providers, including payment gateways, to process your payments and manage payment card information. If you are redirected to a third-party payment processor, you agree to comply with that third party’s terms and conditions. Handyman.dealplex shall not be responsible or liable for any issues arising from your use of third-party payment services.

4.    Authorization and Liability

By providing payment details to avail payment services on Handyman.dealplex, you represent and warrant that you are legally authorized to use such payment details. You accept full responsibility and liability for all payments made using your payment information and confirm that your use complies with applicable laws.

5.    Nature of Payment Facility

The payment facility provided by Handyman.dealplex is strictly a facilitator service that enables electronic online payments using authorized banking infrastructure and card payment gateway networks. Handyman.dealplex is not a banking or financial institution and does not offer banking or financial services.

6.    Additional Fees by Issuers

You acknowledge that certain payment issuers (banks or card providers) may levy additional transaction fees or other charges for processing your payments, which are outside Handyman.dealplex’s control.

 

Order History

If you delete an order from your order history through your account on the Handyman.Handyman.dealplex platform, the order details will no longer be visible or accessible to you through your account. For orders placed for someone else, your action will not affect the visibility of the order details in that person’s account where the order was originally accessible.

You understand that this action is irreversible and Handyman.dealplex will not provide support related to any deleted order(s). This includes any complaints, retrieval of information or invoices, cancellations, returns, replacements, or exchanges for those orders—whether placed by you or on behalf of someone else.

Please note that although the order will be deleted from your view, it will remain in Handyman.dealplex’s records in accordance with our Privacy Policy and applicable record retention laws.

Additionally, there may be circumstances beyond Handyman.dealplex’s control where deleted order details may still be visible or traceable, including but not limited to:

•    Interruptions, service or technology failures, or issues with internet and electronic communications outside of Handyman.dealplex’s control.

•    Order details remaining available in email, messages, or other communication channels of you or the person for whom the order was placed.

•    Direct contact from stakeholders such as third parties or delivery partners using the information you shared with them.

•    Payment details related to the order appearing in your bank statements.

 

 

International Users

“International Users” means users who have registered on the Handyman.dealplex platform using a mobile number registered outside of India and wish to avail the Services.

These terms are in addition to and do not replace or override the other terms and conditions governing the use/access of the Handyman.dealplex platform. In case of any conflict between these terms and other terms, these terms will prevail with respect to International Users.

•    To place an order, you must provide the recipient’s contact details, including name, phone number registered in India, address, or any other information reasonably required to enable delivery. Deliveries are available only to select locations within India.

•    Certain features of the Handyman.dealplex platform may not be available to International Users.

•    Services may be available to International Users only for certain products or services listed on Handyman.dealplex. Not all products/services may be available for sale to or by International Users.

•    Usage of the Services is subject to these Terms and Handyman.dealplex’s Privacy Policy.

•    The available payment methods for International Users will be displayed at the time of payment and may include international cards and other payment methods updated from time to time. Cash on delivery may not be permitted. Additional charges, including foreign currency conversion fees, may apply for certain payment methods and refund processing, which shall be borne by you.

Indemnity

Notwithstanding anything to the contrary, you agree to indemnify, defend, and hold harmless the Handyman.dealplex Parties from and against any third-party claims, damages (actual and/or consequential), actions, proceedings, demands, losses, liabilities, costs, and expenses (including reasonable legal fees) suffered or reasonably incurred by them arising as a result of or in connection with:

•    (a) Your comments and/or content;

•    (b) Your unauthorized use of the Handyman.dealplex platform, services, or products included or advertised therein;

•    (c) Your access to and use of the services;

•    (d) Your violation of any rights of another party; or

•    (e) Your breach of these Terms (including the Privacy Policy and any infringement of intellectual property rights of any third party) and/or applicable law.

Handyman.dealplex retains the exclusive right to settle, compromise, and pay, without your prior consent, any and all claims or causes of action brought against it. We reserve the right, at your expense, to assume exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims. You agree not to settle any matter involving Handyman.dealplex as a defendant or for which you have indemnity obligations without our prior written consent.

We will use reasonable efforts to notify you of any such claim, action, or proceeding upon becoming aware of it. This indemnity clause shall survive the expiry or termination of these Terms.

Limitation of Liability

Notwithstanding anything to the contrary:

•    The Handyman.dealplex Parties shall not be liable for any claims, damages, or losses to you or any other person except as established by a non-appealable order of a court of competent jurisdiction.

•    Subject to the above, the maximum aggregate liability of the Handyman.dealplex Parties, if any, as so established and ordered, shall in no event extend beyond a refund of the money charged from the relevant user for purchases made pursuant to the relevant order with respect to which such liability has arisen and been established.

•    Handyman.dealplex shall not be liable, under any circumstances, whether in contract or in tort, for any indirect, special, consequential, exemplary, punitive, or incidental losses or damages, including loss of profit, loss of reputation, or loss of business opportunities.

•    You must commence any legal action against us within one (1) year after the alleged harm initially occurs. Failure to commence the action within that period shall forever bar any claims or causes of action regarding the same facts or occurrence, notwithstanding any statute of limitations or other law to the contrary.

•    Within this period, any failure by us to enforce or exercise any provision of these Terms or any related right shall not constitute a waiver of that right or provision.

 

Termination

Handyman.dealplex, in its sole discretion and without liability, reserves the right to terminate or refuse your registration, terminate your use of the Handyman.dealplex Platform/Services and/or refuse to permit or restrict your usage/access to the Handyman.dealplex Platform/Services, without notice, with or without cause including if Handyman.dealplex has reason to believe (including through evaluating usage patterns), whether by notice or otherwise that:

(a) you do not conform to the eligibility criteria, or the eligibility criteria is not met or is violated by a user, or

(b) you may commit or be in breach of these Terms (including Privacy Policy).

We may immediately deactivate or delete your account and all related information and/or bar any further access to your account or the Services. If you use the Services in violation of these Terms, we may, in our sole discretion, retain all data collected from your use of the Services. Further, you agree that we shall not be liable to you or any third party for the discontinuation or termination of your access to the Services.

You may delete your account at any time by using the option available on the Handyman.dealplex Platform/App and ceasing further use of the Handyman.dealplex Platform/Services. Your personal data will be processed in accordance with Handyman.dealplex’s Privacy Policy as updated from time to time.

Handyman.dealplex’s rights to any Comments, indemnification rights, and provisions relating to Governing Law and Jurisdiction shall survive any termination of these Terms. Any such termination of these Terms shall not affect or waive your obligation to pay for product(s)/services already ordered or availed from the Handyman.dealplex Platform, nor affect any liability that may have arisen or may arise relating to events preceding the date of termination.

 

Government Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without giving effect to the principles of conflict of laws thereunder.

Courts at New Delhi shall have exclusive jurisdiction over any proceedings arising in respect of these Terms (including the Privacy Policy) relating to Handyman.dealplex and its services.

Miscellaneous

 

Interpretation: The section and subject headings in these Terms are included for reference only and shall not be used to interpret any provisions of these Terms.

Entire Agreement and Waiver: These Terms, together with the Privacy Policy, constitute the entire agreement between you and us concerning the Services provided by Handyman.dealplex. No failure or delay by us in exercising any right, power, or privilege under these Terms shall operate as a waiver of such right or acceptance of any variation of the Terms, nor shall any single or partial exercise by either party of any right, power, or privilege preclude any further exercise of that right or the exercise of any other right, power, or privilege.

Severability: If any provision of these Terms is deemed unlawful, invalid, or unenforceable by a judicial court for any reason, then that provision shall be severed from these Terms, and the remainder of the Terms shall continue in full force and effect.

Partnership or Agency: None of the provisions of these Terms shall be deemed to constitute a partnership or agency between you and Handyman.dealplex, and you shall have no authority to bind Handyman.dealplex in any form or manner whatsoever.

 

Pharma Products & Healthcare Consultation Services

The following terms are in addition to, and do not substitute or derogate from, the other terms and conditions governing the use and access of the Handyman.dealplex platform.

Handyman.dealplex provides a platform for third-party sellers and third-party service providers (“Healthcare Consultants,” such as independent medical/healthcare practitioners listed directly on the platform or via third-party agencies/service providers) to extend an “invitation to offer for sale” (not an “offer for sale”) of OTC medicines, prescription medicines (as permitted under applicable law), consumables, pharmaceutical products, and related equipment (“Pharma Products”) and to provide medical/health teleconsultation services (“Healthcare Consultation Services”) to consumers.

You understand that the listing and display of Pharma Products, Healthcare Consultation Services, or related information on the Handyman.dealplex platform does not constitute an “exhibition” or an “offer for sale,” nor do the Healthcare Consultation Services create any “doctor-patient relationship” between you and Handyman.dealplex. When you place an order or request, it constitutes an “offer to purchase” the Pharma Products from third-party sellers or an “offer to avail” Healthcare Consultation Services from Healthcare Consultants. Order confirmation is only an acknowledgment that the third-party sellers or Healthcare Consultants have received your request and does not imply acceptance of your offer. Acceptance and fulfillment are subject to these Terms.

Handyman.dealplex is not a party to any transaction between you and the third-party sellers or Healthcare Consultants. Purchasing Pharma Products or availing Healthcare Consultation Services is your independent choice and responsibility, to be used for bona fide, legitimate, genuine, and lawful purposes only, at your own risk and prudent judgment, and not for misuse. You confirm awareness of usage instructions, dosage, storage conditions, side effects, drug interactions, and risks related to missed or overdose of Pharma Products. You undertake to purchase Pharma Products and avail Healthcare Consultation Services only as permitted by law, including submitting valid prescriptions where required, complying with prescription use limits, and not reusing prescriptions improperly.

Healthcare Consultants are independent third parties responsible for providing their services based on their professional judgment. Their findings, assessments, diagnoses, opinions, and advice via the Handyman.dealplex platform are their own and not endorsed by Handyman.dealplex. Prescriptions issued may not be accepted by all sellers or pharmacies. You agree not to misuse such prescriptions.

Handyman.dealplex does not guarantee, endorse, or assume liability for the sale, purchase, effects, authenticity, or quality of Pharma Products or the Healthcare Consultation Services. These are the sole responsibility of third-party sellers and Healthcare Consultants. Handyman.dealplex is not liable for any act, omission, breach of law, negligence, professional conduct, or contract performance related to these products or services. Information provided by third parties is for informational purposes only and is not an advertisement, promotion, solicitation, or recommendation.

To facilitate sale or service provision, you must provide accurate, complete, and truthful information and documentation (including valid prescriptions) as required. If you order prescription Pharma Products without a valid prescription, Handyman.dealplex may arrange a consultation with a registered medical practitioner. The issuance of a prescription and fulfillment of the order depend on the Healthcare Consultant’s diagnosis and professional judgment. Any substitutions require written permission from a registered medical practitioner.

Orders may be cancelled by Handyman.dealplex if suspected of fraud, violation of Terms, discrepancies in provided information, professional judgment deeming virtual consultation insufficient, unavailability of products, or technical/logistical reasons. Delivery may require you to present the original prescription to delivery personnel; failure may result in cancellation and refund within approximately 72 hours.

You may order for yourself or as an authorized caregiver for others, provided you disclose this status and relationship upfront and confirm consent from the person concerned. You indemnify Handyman.dealplex against any claims arising from unauthorized use, misuse, or inaccurate information.

You acknowledge risks associated with virtual healthcare services, including lack of physical examination, incomplete history, and technical failures. For critical or emergency situations, you should seek in-person medical help. Services may be refused or cancelled based on such assessments.

Consultations may be recorded. By using these services, you authorize Handyman.dealplex and its partners to collect, store, process, share, and use your data, documents, prescriptions, and recordings as necessary under these Terms and the Privacy Policy. This includes sharing information with third-party sellers, Healthcare Consultants, and service providers. You agree to receive communications related to your orders or consultations.

Even if Healthcare Consultation Services are provided free of cost at Handyman.dealplex’s discretion, these Terms apply fully. An invoice may not be issued in such cases.

 

Fraud Prevention & Responsible Usage Policy

To protect users and ensure compliance with applicable laws, Handyman.dealplex maintains a strict stance against any misuse of the platform, financial fraud, or deceptive practices. By using the Handyman.dealplex Platform, you expressly agree to comply with the following:

1.    No Instant Money or Get-Rich-Quick Schemes:

Handyman.dealplex does not engage in, promote, or support any form of “instant money”, “get-rich-quick”, cashback manipulation, financial return promises, or investment schemes. Any communication or offer claiming instant monetary returns or unrealistic benefits on behalf of Handyman.dealplex is fraudulent and must be reported immediately to Handyman.dealplex customer support.

2.    No Bank or Financial Frauds:

Handyman.dealplex will never request sensitive financial details such as full debit/credit card numbers, CVV, OTPs, UPI PINs, or net banking passwords over phone, SMS, email, or any third-party channel. Users are strongly advised not to share such information with anyone claiming to represent Handyman.dealplex. Handyman.dealplex shall not be held responsible for any loss or fraud resulting from such actions.

3.    No Unauthorised Promotional Offers:

Only those promotional campaigns officially communicated via Handyman.dealplex's platform (website, app, or verified emails/messages) should be considered valid. Users must avoid falling for fake promotions, phishing messages, or unofficial links that misuse Handyman.dealplex’s name, logo, or brand identity.

4.    No Resale or Commercial Misuse:

The platform and its services are intended strictly for personal, non-commercial use. Bulk purchasing for resale, using fake credentials, or impersonating others to misuse promotions or services is strictly prohibited and may result in cancellation, blacklisting, and legal action.

5.    Fake Orders or Impersonation:

Placing fake or fraudulent orders, using forged prescriptions or medical records, impersonating individuals, or providing false caregiving declarations are violations of law and Handyman.dealplex policies. Such activities will result in suspension of service access and may be escalated to law enforcement.

6.    Report Suspicious Activity Promptly:

Users are encouraged to report any suspicious, fraudulent, or unauthorized activity encountered while interacting with Handyman.dealplex or its representatives. Prompt reporting helps us protect users and enforce action against misuse.

7.    Compliance With Applicable Laws:

All users are required to use the Handyman.dealplex Platform for lawful purposes only. Any use in violation of applicable Indian laws, including the Information Technology Act, Drug and Cosmetics Act, Consumer Protection Act, and relevant banking regulations, shall result in appropriate legal action.

8.    No Gambling, Lottery, or Betting:

Handyman.dealplex does not offer or facilitate any form of gambling, lottery, wagering, or betting services, directly or indirectly. Any promotional activity or offer on the platform is purely for customer engagement and does not involve games of chance, stakes, or monetary gambling of any kind.
